TravelJoy's direct invoices, direct booking pages, and smart proposal payment features employ a "clickwrap agreement" to collect the client's agreement with the listed terms and conditions.
What is a clickwrap agreement?
A clickwrap agreement is an action the client must take to continue with a transaction, and this action indicates an agreement with the listed terms. This is similar to the checkout flow of online shopping sites, which use clickwraps instead of signatures to protect their business without adding friction for the client during checkout.
The clickwrap is the most commonly used type of online agreement.
Are clickwraps equal to name-based signatures?
Yes!
The standards for acceptable electronic agreement, at least in the US, are outlined in the Electronic Signatures Act and the Uniform Electronic Transactions Act, which both explicitly include clickwrap agreements as an accepted form of electronic signature. In fact, the UETA specifically lists "the standard webpage click through process" as an option.
Can we change to signatures instead?
While we certainly understand that both "wet ink" and electronic name-based signatures have long played an important role in the industry, it is important to remember that clickwraps are signatures. This method collects an equally-enforceable agreement from your clients.
While we do not currently have plans to add name-based signatures to these pages, we are always collecting feedback from our members and this may change in the future.
